Description

Benjamin N. Cardozo was an influential American lawyer and judge. Born in 1870, Cardozo attended Columbia College at fifteen and, after briefly attending law school, entered into a distinguished legal career. He then served on the New York Court of Appeals for 18 years, delivering many original rulings, especially on tort and contract law. During this time, Cardozo gave a number of lectures at various universities. The present volume is one such lecture, given at Yale University Law School in 1924.  In 1932, President Hoover selected Cardozo to succeed Oliver Wendell Holmes Jr. on the Supreme Court of the United States. Upon his appointment, The New York Times wrote that “seldom, if ever, in the history of the Court has an appointment been so universally commended.” During his time on the Supreme Court, Cardozo was a member of the “Three Musketeers,” a group that also included Justices Brandeis and Stone. Although his stay on the court was brief — he would only remain until his death in 1938 — Cardozo made his mark on the court, remaining a distinguished name in the legal profession to this day.

Cardozo develops further in this book the theory of law expressed in The Nature of Judicial Process.  Having dealt with the question, “How do I decide a case?” he now asks, “How should I decide it?”
